Count of Albret - married but available to marry (1066 scen)

Just started a game as the Count of Albret, mainly so I can see how the Iberians go. The Duke starts married to Mathilde d'Albret, and yet I could propose marriage on his behalf. He's now married to her, and Sancha Jiminez. Lucky boy.

Perhaps the marriage is annulled ie divorce with deathdate? Or just too fast copy/paste as a culprit.
