I think, it`s WAD but it doesnt make much sense.

I was playing as Count of Bourbon and had enough counties to form Duchy of Bourbon, but I couldn`t create it because I was a vassal of Duke of Berry. When I felt I was strong enough, I declared independence war against Duke of Berry. Since I was technically not his vassal, I could create Duchy. As soon as I created it, war ended inconclusively.

I think, independence wars should not end if former vassal creates new titles.

Do you have a save game of this issue? Sorry for late response.
1. Start game in 1066 as Count of Auvergne.
2. Cheat yourself enough money.
3. Declare independence war on Duke of Aquitaine.
4. Create Duchy of Auvergne.
5. On the next day your war ends inconclusively.
 
I think there is a difference here between creating a currently non-existent title and usurping a title.

If you go to war with your liege for independence you will not be able to usurp his King title because he is at war (with you) and you cannot usurp titles from somebody at war.

The issue with the Duchy title is slightly different. As a vassal of a Duke you cannot create (or usurp from a third party) another Duchy title because this would promote you to the same rank as your liege and that breaches the game's rules. However, once you declare independence from your Duke liege you are now free to create (or usurp) that other Ducal title because it does not belong to your liege. As soon as you do that you are now of the same rank as your former liege and the independence war is irrelevant because you cannot be his vassal at that rank.

I think that this is one of a number of scenarios where the game design has had some unintended consequences due to unforeseen events during wartime (another being crusades or other wars ending when the target ceases to be independent even though the independence of the target was not relevant to the CB for the war) and so rather than fixing this in isolation (if it is accepted as a bug) it would be prudent to look at all similar issues together.

That said, the simple fix here would be to prevent a player from creating or usurping new titles of any sort whilst engaged in a war of independence.
