I am playing Portugal. In the New World one of my armys wanders into a Spanish army. A battle occurs, even though I am not at war with Spain.

This might happen, when the Treaty of Torsedillas (don´t know, if it is spelled correctly...) comes up, which says, that the land in the new world is devided between Portugal and Spain.

When the treaty of Tordesillas come to effect both Portugal and Spain can attack other countries forces overseas without a declaration of War, dont remember the exact date for that event.
The treaty of Tordesillas is an historical events that appear (I think) when a first non Spanish/non Portuguese country builds a TP/colony in the New World.
It divides the New world in a Spanish and a Portuguese influence zone (see shields in the colonial map).
Spain, resp. Portugal can attack without DoW any Catholic country that builds a TP/ COlony in such a province.
If they control it, it is theirs automatically.
The treaty is cancelled by the Edict of Tolerance.
If you don't want to be bothered by it, convert to Protestantism (I even did it once with Portugal to install my TPs and colonies in the Spanish Zone).

Well, as a protestant Sweden I had a clash with spain when my (random) conquistador met a spanish force north of califonia. I had a bit of panic until I found out that we werent at war. The province where the spanish force were was unknown to me before I entered.
So I think that Spain was fighting some natives when I entered was the source, not the Tordesillas treaty.

The same thing happened to me as the Portuguese when I wandered into a large French army just south of Mombasa in East Africa. I had a small force, the Frogs outnumbered me about 5:1 and I got my butt kicked.

Damn, I was thinking about this very thing today. There are some unfortunate English colonies in Spanish North America. While I could take them quickly, I didn't want to risk a continental war.
Too bad it doesn't work on Protastants.
