Yes and no, in that order. It's defined in province.csv (like the Treaty of Tordesillas areas).

I think it was hardcoded to happen at the Edict of Tolerance. Since the borders (and maps) are now moddable, that doesn't make sense any more.

It was inside the source code. IIRC, Johan said he had to remove this part in 1.09 (and betas before) in order to have borders of the HRE moddable (inside province.csv), all HRE provinces being hardcoded before.

This was the "deal" for the existence of mapmods.
 
so, if i really wanted to change HRE borders during an AAR for example, without cracking the source code, which is way beyond me in any case; i could turn a save into a scenario, and then insert that scenario into a new moddir ( with HRE-borders modded)
