Please explain your issue is in as much detail as possible.
When the emperor of Frankia died in battle and inherited by seniority by a cousin who's the king of East Frankia (independent), the new ruler cannot peace out as it needs a random person to occupy the rebel leader's territory. Even with 100% war score the peace out options, all the three are all greyed out.

Steps to reproduce the issue.
at war with someone,
ruler dies in battle
inherited by someone outside of your empire

is a completely wrong conclusion of what's going on, sorry.

By the way, it's been that way for nearly ever.

Explanation:

There are counties of your revolting vassals occupied by foreign forces.
Only when no foreign forces occupy any of your revolting vassals land can you make peace.

It says in the tooltip when you hover over SEND who you have to fight.
"Mikel" is the revolter in Sardinia, the other the Basileus of the ERE.

What you have to do is to unoccupy/siege/free the holdings of Bari of your revolting vassal in Sicily, which are currently occupied by the ERE/Byzantium.
You are hostile to the ERE for that reason.
You have to do the same in Sardinia against the revolt there occupying Arborea and should be hostile to them naturally.
Then you can make peace.
