Unfortunately, it appears to be a deliberate choice. I agree that it should be changed. All it would take is one line copy-pasted. To elaborate: the devs clearly thought of a scenario in which the overlord might not be fascist anymore (an independent and non-aligned Manchuckuo) but failed to consider that the same DLC that added this also added a non-aligned path for Japan. Big facepalm moment.
