I recently started playing EU, and I'm trying to colonize South America. I've fought the Incas, and am expanding fairly well, but Spain is giving me problems (big surprise). The Treaty of Tortisallis (I'm butchering the name, but you know what I mean) has passed, meaning Spain and I can go hog wild in the new world w/o declaring war on European countries, right? I ask because here's my problem:

I've set up a level1 colony on the Isthmus, and have about 5000 infantry there with no special general. For some reason Spain can walk right in to the Isthmus from Central America, use a 600 person army to chase off my army WITHOUT DECLARING WAR, and call the Isthmus his own. BUT I CAN'T DO THE SAME BACK TO HIM!! I can declare war and take the Isthmus back, but then my European holdings get a real angry knock on the front door.... Should I mention this drives me slightly nuts?!

I thought the Treaty said Spain and Portugal can each take non-Euro land w/o declaring war. Do I need to stay in the Brazilian area to take advantage of this?

No, the threaty means that you and spain split the world among you two. The areas 'owned' by both sides can be seen in colonising screen (small shields) and owner of that shield can take that province from enyone else (exept protestant/reformed nations).

As portugal you get brazil, africa most of far east as your own. Spain gets most of americas and filipines(?)

You are dead right; Mr. Sandman has wandered into a Spanish zone of control for the Treaty; he can do the same to Spanish troops if they are located on his possessions....
The only way the Treaty can be altered is by a DOW and concession; otherwise, Sandman, you'll have to wait until the Treaty expires.....

I'm not sure that it was a battle that was lost. I think because the province instantly became under Spains' ownership that he had to move off the province.Maybe the was an actual battle , maybe not. I have yet to play Spain or Portugal so I cant really say for sure what happened there.
 
I don't know how I lost.... moral was fine, I had the numbers game won, tho I didn't check who the Spanish general was (Cortes maybe? I haven't played Spain so I don't know his stats). Tho that's why I like the game, numbers aren't everything.... it goes both ways!~
 
Yeah, that treaty cost me a game once as Venice. I had colonised Table with a level 1 or 2 fort and had some infantry protecting it. Portugal declared war and sieged Table - I got a Peace treaty but forgot all about Tordesillas so the Portugese army remained in Table and took it. If that army hadn't been in Table at the time I doubt that Portugal would have tried that.
