IIRC, Microsoft owns the BattleTech IP, so they can do what they want.
Microsoft own the digital rights, Topps owns the physical rights (which CGL license). There are limits on what can and can't be used between them, thus why video game only stuff isn't automatically canon for TT, they have to negotiate inclusions.
