Please explain your issue is in as much detail as possible.
I was Emperor, had a large king-tier bishop vassal residing in Rome (temple as capital) and ruling Poland. Post "mending the Shism" as orthodox. Holy warred the Pope for Latium. Got Orvieto and Orbetello. Ursurped the Kingdom of Ravenna. Created the duchy of Latium. Tried to give a county (Orvieto or Orbetello) (castle as capital) to an unlanded courtier. Wasn't allowed, because then I would have more than 10% of theocracy-vassals. When I tried to give them the Duchy with: " [✔] include lower tier titles" active, I did NOT grant them any title and destroyed the Duchy of Latium.
Steps to reproduce the issue.

(Be Emperor. Have a king-tier bishop in a duchy capital with many subjects. Have another county and said duchy. Try to grant the Duchy with [✔] include lower tier titles to a courtier. Destroy Duchy and retain Counties.)
