Yeah less of a game not working but more of a game not making sense. Logically you shouldn't be able to remain the head of a religion if you've converted to a different one.
I'm not so sure about that. There's always been rumblings that maybe someday the Orthodox and Catholic churches could be reunited. It happened in that game.

in game terms, I think it's a no-brainer. the patriarch has to be orthodox, because otherwise he won't like orthodox rulers ("different religion" penalty)
I think if this is supposed to reflect a reconciliation between Catholic and Orthodox churches then there needs to be events for the Orthodox rulers to accept it or something else to happen. Then there should be an event for the Emperor to decide to convert or to start a war over it. Maybe something else should be done, but I think that would be a good start.
