It happens all the time in my games.

yeah I reported this before. You need to either temp grant govt monopoly on it and queue it up, or pause and make sure you stick one in govt queue immediately so they don't build one. It's awful and stupid.

Having the same issue and came here to report this. AI is spamming multiple railroads in 80% penalty provinces. It queued up 7-8 such railroads and a decade later, still working on this queue only.

This is a game breaking bug since it completely kills private investment for decades.
