Scaling Difficulty can't be turned on (PS5)

If I want to play a new game, I can't turn on the scaling difficulty in the game details. I tried to restart, re-install the game and rebuild the database of my PS5. Also, after playing around in the game details, I couldn't fix the issue. This bug first showed up after the new console update of today. I own every DLC except of the DLC's of expansion pass six, and it makes no different if I deactivate them.
