Senate asks to appoint an imprisoned character as general

As Rome, sometimes it happens I have some legions without commander and the senate asks very often to appoint an imprisoned character (imprisoned by Rome) as their commander. Even if I accept, the character it isn't released so the legions remain without commander and after some time the senate asks again the same question.

Sometimes the senate even asks for an imprisoned character you seized from another country.

Or an imprisoned character held by another country. Those are especially fun when the country in question no longer exists.
